In accordance with the provisions of Ley 34/2002, de 11 de julio, de servicios de la sociedad de la información y de comercio electrónico (Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, LSSI-CE), the following information is provided:

2. USERS

By means of this document, we inform you of the terms and conditions governing the use of the Owner’s website and/or app, as well as the associated services and content. Such use implies the acquisition of the status of “user” and, with that status, a series of rights and obligations.

For the purposes described above, we inform you that it is your responsibility to access the legal conditions contained on this website, as well as the privacy and cookie policies or, where applicable, the conditions of sale, and to read them carefully. We recommend:

    1. That you consult them each time you intend to access or use the services and content of the site, and
    2. That you print or store a copy on your system.

3. USE OF THE PORTAL

This website provides access to a wide range of information, services, programmes or data (hereinafter, “the content”) on the Internet belonging to the Owner or its licensors, to which the User may have access.

The User assumes responsibility for the use of the portal under the terms established herein. This responsibility extends to any registration that may be necessary to access certain services or content. In such registration, the User shall be responsible for providing truthful and lawful information. As a result of this registration, the User may be provided with a password, for which they shall likewise be responsible, undertaking to use it diligently and confidentially.

  • Use the website or the information contained therein for commercial, political or advertising purposes or for any commercial use, in particular the sending of unsolicited emails.

The Owner reserves the right to remove any comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist or pornographic, that threaten young people or children, public order or public safety or that, in its opinion, are not suitable for publication. In any event, the Owner shall not be liable for the opinions expressed by users through forums, chats or other participation tools.

4. DATA PROTECTION

All matters relating to the processing of your personal data are set out in the privacy policy.

5. CONTENT. INTELLECTUAL AND INDUSTRIAL PROPERTY

The Owner holds all intellectual and industrial property rights to its website, as well as to the elements contained therein (by way of example: images, photographs, sound, audio, video, software or texts, trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), which are owned by the Owner or by its licensors.

All rights reserved. Pursuant to the provisions of Articles 8 and 32.1, second paragraph, of the Ley de Propiedad Intelectual (Spanish Intellectual Property Law), the reproduction, distribution and public communication, including making available, of all or part of the content of this website for commercial purposes, in any medium and by any technical means, without the authorisation of the Owner, are expressly prohibited.

6. EXCLUSION OF WARRANTIES AND LIABILITY

The User acknowledges that the use of the website and its content and services is carried out under their sole responsibility. Specifically, and by way of example only, the Owner accepts no liability in the following areas:

  • The availability of the operation of the website, its services and content, and their quality or interoperability.
  • The extent to which the website serves the User’s objectives.
  • Infringement of current legislation by the User or third parties and, in particular, of intellectual and industrial property rights owned by other persons or entities.
  • The existence of malicious code or any other harmful computer element that may cause damage to the computer system of the User or of third parties. The entity takes measures to protect the website against cyberattacks. However, it cannot guarantee that unauthorised access by third parties will not occur. It is therefore the User’s responsibility to have suitable tools for the detection and removal of such elements.
  • Fraudulent access to the content or services by unauthorised third parties or, where applicable, the capture, deletion, alteration, modification or manipulation of messages and communications of any kind that such third parties may carry out.
  • Damage caused to computer equipment during access to the website and damage caused to Users when it originates from failures or disconnections in telecommunications networks that interrupt the service.
  • Damage or loss arising from circumstances occurring as a result of unforeseeable circumstances or force majeure.

Should the User detect any unauthorised use of their account, they must notify the Owner immediately. Where forums or other similar spaces exist, it must be borne in mind, with regard to their use, that messages reflect only the opinion of the User who sends them, who is solely responsible for them. Consequently, the Owner is not responsible for the content of messages sent by the User.

7. AMENDMENT OF THIS LEGAL NOTICE AND DURATION

The Owner reserves the right to make, without prior notice, any modifications it deems appropriate to its portal, and may change, delete or add both the content and services provided through it and the way in which they are presented or located on its portal.

The validity of these conditions shall depend on their publication, and they shall remain in force until they are amended by others duly published.

8. LINKS

Should links or hyperlinks to other Internet sites be included on www.thu.es, the Owner shall not exercise any control over such sites and content, nor shall it assume any liability for the content of any link belonging to a third-party website, nor shall it guarantee the technical availability, quality, reliability, accuracy, scope, truthfulness, validity or constitutionality of any material or information contained in any such hyperlinks or other Internet sites. Likewise, the inclusion of these external connections shall not imply any type of association, merger or participation with the connected entities. Notwithstanding the foregoing, should THU PERFIL, S.L.U. obtain actual knowledge that the activity or information to which it refers or which it recommends is unlawful, or that it harms the property or rights of a third party liable to compensation, such data shall be removed or the corresponding link shall be disabled.

9. RIGHTS OF EXCLUSION

The Owner reserves the right to deny or withdraw access to the portal and/or the services offered, without prior notice, on its own initiative or at the request of a third party, to any users who fail to comply with the content of this Legal Notice.

10. GENERAL PROVISIONS

The Owner shall pursue any breach of these conditions, as well as any improper use of its portal, by exercising all civil and criminal actions to which it may be entitled by law.

11. APPLICABLE LAW AND JURISDICTION

The relationship between the Owner and the User shall be governed by current Spanish legislation. All disputes and claims arising from this legal notice shall be resolved by the competent Spanish courts and tribunals for consumers and users.

12. MINORS

This website directs its services to users over 18 years of age. Persons under this age are not authorised to use our services and must not, therefore, send us their personal data. Please note that, should such a circumstance arise, the Owner shall not be liable for any consequences that may arise from failure to comply with the notice set out in this clause.

13. SECURITY MEASURES – SSL

The Owner has contracted an SSL («Secure Sockets Layer») certificate for its website. This SSL certificate makes it possible to protect all personal and confidential information that may be handled on a website, regardless of the information being transmitted, for example from any of the contact forms on the website to the server, or the data entered to subscribe to newsletters, access to protected areas, etc.

The website address will appear in green, activating the “https” protocol, which enables secure connections from a web server to the user’s browser.
